Thomas Macody Lund ble på Landsmøtet i København lørdag 5. mai valgt til ny president i Norsk Skipsmeglerforbund. Han arbeider til daglig i Odfjell Tankers AS i Bergen og etterfølger Lars Petter Storfjord fra Strand Shipping AS i Mo i Rana som president. Lars Petter Storfjord ble behørig takket av for sin innsats for Norsk Skipsmeglerforbund gjennom 10 års styrearbeid, hvorav de siste 2 år som president.
André Borge fra Wagle Chartering i Moss ble også takket av for sitt arbeid for Forbundet gjennom 6 års styrearbeid. Landsmøtet valgte også 2 nye styremedlemmer; Pål Bøhaugen fra Th. Jacobsen & Co. AS i Sarpsborg og Tom Engø fra Strand Shipping AS i Mo i Rana.

The Federation of National Associations of Shipbrokers and Agents, (FONASBA), has given an enthusiastic endorsement to the newly released SALEFORM 2012 developed jointly by the Norwegian Shipbrokers Association (NSA) and BIMCO. SALEFORM is the shipping industry’s most widely used agreement for the sale and purchase of second hand ships. SALEFORM 2012 builds upon SALEFORM 93 retaining the accepted general principles and familiar structure.
Congratulating NSA, a Full Member of FONASBA, and BIMCO, a Club Member, on their actions to update the most successful sale and purchase agreement on the market, the President of FONASBA Christakis P. Papavassiliou from Cyprus said:
“At FONASBA we are pleased and proud to support publication of the revised NSF 2012, a document whose development reaffirms the position of NSA and BIMCO at the forefront of our profession. The enthusiasm and professionalism shown by these two FONASBA members in taking the updating project forward reflects this Federation’s commitment to the maritime industry in terms of professional integrity and quality of service. FONASBA fully endorses the revised SALEFORM 2012 and has already called upon its members in 49 countries around the globe to support it”.
Echoing the President’s comments, Marygrace Collins of the USA, Chair of the FONASBA Chartering & Documentary Committee and the Federation’s President Designate added:
“We are confident that the initiative taken by the NSA together with BIMCO will ensure that the NSF remains the premier document of choice for S&P transactions worldwide”.
FONASBA is the only organisation representing the global ship agency and ship broking professions. Established in 1969 it now has members in 49 countries, including all major maritime and trading nations. Its remit is to “promote and protect the professions of ship agency and ship broking worldwide”, a task which it undertakes through dialogue with its member associations and its consultative status with IMO, UNCTAD, UNCITRAL and the World Customs Organisation, as well as through close and regular dialogue with the European Commission and other regional bodies. FONASBA also enjoys reciprocal memberships with the Baltic Exchange, BIMCO, INTERTANKO, indemnity insurer ITIC and the Shipbrokers’ Register and works closely with other bodies, both internationally and in Europe.

Det innkalles med dette til Landsmøte i Norsk Skipsmeglerforbund og Årsmøte i Skipsmeglernes Servicekontor lørdag 5. mai 2012 kl. 10.00 på Radisson Blu Royal Hotel i København. Endelig innkallelse med agenda blir tilsendt senest 2 uker før avholdelse.
Saker som ønskes behandlet på Landsmøtet eller Årsmøtet må sendes Forbundet/Servicekontoret senest 9. mars. Forslag fra medlemmer tilknyttet lokalforeninger må innsendes via lokalforeningen gjennom styret, etter behandling der.
Dette blir et tradisjonelt Landsmøtearrangement med ledsagere. Arrangementet starter med en “get together” fredag 4. mai og avsluttes med festmiddag lørdag 5. mai.

BIMCO and the Norwegian Shipbrokers’ Association (NSA) are proud to announce the launch of the new edition of SALEFORM – the industry’s most widely used agreement for the sale and purchase of second hand ships.
SALEFORM 2012 builds upon the international success of its predecessor, SALEFORM 93, while retaining the accepted general principles and familiar structure of the ’93 edition. The decision to revise SALEFORM followed from consultation with the global second-hand ship sale sector who felt that the industry would benefit from a modest update of this widely-used agreement.
The new edition incorporates many of the commonly made amendments applied by the industry. Certain provisions in the ’93 edition which are known to have created uncertainty and misunderstanding have been re-worded in SALEFORM 2012 – resulting in much greater clarity.
Care has been taken to avoid the agreement becoming overly prescriptive. The emphasis during the revision has very much been on retaining SALEFORM’s character as a commercially flexible platform agreement on which to base a wide variety of different types of ship sale around the world.
According to BIMCO’s Deputy Secretary General, Mr Soren Larsen, “Together with the NSA, BIMCO is delighted to bring this updated edition of SALEFORM to the market. We have listened carefully to what the industry wanted and we believe that users will welcome this much improved version of what is recognised globally as the standard contract for the international sale and purchase of ships”.
The Norwegian Shipbrokers’ Association Director, Mr Knut Frode Eriksen, added that “The NSA is very pleased to have worked closely with BIMCO again to revise this most important standard document. We first developed SALEFORM in 1925 and have since 1956 collaborated with BIMCO on subsequent revisions of SALEFORM. Recognizing the leading role BIMCO have in developing and promoting quality documentation in international shipping, we are proud to yet again have successfully completed a revision of SALEFORM that has met with BIMCO standards and approval. We are confident that the revision reflects the needs of the industry and brings improvements to the agreement that will be very much welcomed by users around the world”.
Copies of SALEFORM 2012 can be obtained through BIMCO (www.bimco.org) and the NSA (www.shipbroker.no) along with explanatory notes highlighting the differences between the new edition and the ’93 edition.
SALEFORM 2012 Explanatory Notes
SALEFORM er verdens mest brukte avtaleformular for kjøp og salg av skip og har siden høsten 2010 vært gjenstand for en moderat revisjon. Det nye dokumentet er et resultat av et betydelig arbeid i en arbeidsgruppe nedsatt av Norsk Skipsmeglerforbund som har samarbeidet nært med BIMCO. I prosessen har også industrien vært involvert gjennom konsultasjoner i Oslo, London og Singapore. Resultatet er et nytt dokument som industrien ønsker og som har tatt inn de mest vanlige endringer som blir foretatt i den tidligere versjonen (1993).
SALEFORM 2012 vil bli presentert av advokat Henrik Aadnesen i Nordisk Skibsrederforening. Han har vært helt sentral i revisjonsprosessen som deltaker i Norsk Skipsmeglerforbunds arbeidsgruppe og vil gå gjennom endringene og hvordan de påvirker den praktiske bruken av SALEFORM.
Andre medlemmer av Norsk Skipsmeglerforbunds arbeidsgruppe vil også være tilstede på seminaret og tilgjengelige for spørsmål, så dette er en god mulighet til å møte og snakke med de som har vært sentrale i revisjonsarbeidet.
